Welcome to Dollarback. Please carefully read these Terms of Service ("Terms," "Agreement") before using the website, services, and cashback features operated by Dollarback ("Company," "we," "us," or "our").

By registering an account or accessing our Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use Dollarback.

1. Account Registration & Eligibility

• Mandatory 18+ Age Requirement: You represent and warrant that you are at least eighteen (18) years of age (or the legal age of majority in your state or country of residence) on the effective date of your registration, in compliance with CJ Publisher Service Agreement Section 8(b) and Impact.com Partner User Agreement Section 9.10(n) & Section 10. Individuals under 18 (and Data Subjects under 16 per CJ Section 6(c)) are strictly prohibited from registering or using Dollarback.
• Single Account Limit & Bona Fide Visitor Status: Users may maintain only one (1) active Dollarback account. Under CJ Section 1(d)(ii) and Impact Section 1.2(b)–(c), qualifying transactions must be genuine, bona fide purchases made in good faith. Registering multiple accounts, submitting multiple leads or orders from the same individual, entity, or IP address to game referral payouts, or manipulating account details is strictly prohibited and constitutes grounds for immediate account termination and balance forfeiture.
• Accuracy of Data: You agree to provide true, current, and complete profile information (including full legal name and valid Venmo account details) necessary for receiving cashback payments.

2. Cashback Program Mechanics, Qualifying Purchases & Cashback Locking

Dollarback offers user cashback rewards by sharing commissions received from participating merchants through affiliate networks (including Commission Junction LLC / CJ Affiliate, Impact Tech, Inc. / impact.com, Rakuten Advertising, and others).

• Affirmative User Click & Per-Trip Occurrence Limits: To earn cashback, you must start your shopping journey directly from Dollarback by intentionally clicking an active store referral link prior to completing your purchase at the merchant's site. Members should initiate a fresh click-through session on Dollarback prior to each individual checkout, as certain participating merchants limit commission eligibility to one (1) order per referral click (or up to two (2) orders per referral click within the merchant's referral cookie window).
• Prerequisites for Tracking: Cookies and affiliate tracking consent must be enabled on your browser. Opting out of affiliate tracking (`db_tracking_consent = opted_out`), disabling cookies, clicking third-party coupon/deal site links after leaving Dollarback, or using ad-blocking/privacy software during checkout will prevent affiliate attribution and result in uncredited cashback.
• Pending Cash Back & Merchant Verification Locking Windows: Cashback transactions are posted initially as "Pending" until the participating merchant and affiliate network verify that the transaction was fully completed, delivered, and not subject to returns, cancellations, or store credit adjustments. Pending Cash Back unlocks to Available Balance only after the participating merchant's verification and return lock period closes (typically around the 10th of the month following purchase for standard merchants, or up to 60–90 days for merchants with extended return verification windows such as electronics retailers).
• 5-Point Charge-Back & Reversal Policy (CJ Section 3(b) & Impact Section 3.1): An Advertiser or affiliate network (including CJ Affiliate and Impact.com) may apply, and Dollarback will correspondingly apply, a debit/reversal ("Charge-back") to your Pending or Available Account balance equal to a cashback reward previously credited in any of the following five (5) circumstances:
  1. Product Returns or Cancellations: The purchased merchandise or service is returned, canceled, or exchanged in whole or in part;
  2. Duplicate Entry or Clear Error: Duplicate transaction reporting, technical attribution error, or other clear calculation error;
  3. Non-Bona Fide Transactions: Any transaction not made in good faith, including self-referral gaming, automated bots/scripts, hidden iframes, or multiple leads/orders from the same individual, entity, or IP address;
  4. Non-Receipt or Refund of Payment: Non-receipt of payment from, or refund/chargeback of payment to, the Visitor by the Advertiser; or
  5. Non-Compliance with Advertiser Program Terms: Failure to comply with the Advertiser's specific Program terms or agreement (such as applying unauthorized coupon codes, purchasing gift cards, or buying excluded items).
  Charge-backs may be applied to your Dollarback ledger at any time, including across previous payment cycles.

3. Cashback Payouts & Conditions

• Payment Options: Payout disbursements are issued electronically to the recipient's designated Venmo account, subject to user profile completeness and account verification.
• Minimum Payout Threshold: Individual qualifying purchases earn cashback as a percentage of the net order total (which may be less than $1.00 on smaller transactions). Cashback from multiple qualifying orders accumulates in your account. You may only request or receive a Venmo payout disbursement after your confirmed "Available Balance" (excluding Pending balances) shows at least one dollar ($1.00).
• Account Details & Recipient Accuracy: Users are solely responsible for ensuring that their designated Venmo handle and associated recipient details are accurate and current. Dollarback is not liable for lost, delayed, or misdirected payments resulting from user typographical errors or invalid payment handles.
• Unclaimed Accounts & Inactivity: Accounts with no login or shopping activity for twelve (12) consecutive months may be flagged as inactive. Dollarback reserves the right to charge an administrative maintenance fee or forfeit unredeemed non-cash rewards in accordance with applicable state unclaimed property laws.

4. Prohibited Activities & Fraud Prevention

You expressly agree NOT to engage in any of the following prohibited behaviors:

• Using automated bots, scripts, crawlers, headless browsers, or scrapers to interact with Dollarback or merchant websites.
• Deploying cookie-stuffing techniques, hidden iframes, 1x1 tracking pixels, forced redirects, or pop-unders to simulate affiliate referrals without genuine user clicks.
• Applying unauthorized, leaked, private employee, or non-affiliate coupon/promo codes during checkout to claim ineligible cashback rewards.
• Creating multiple accounts, submitting multiple leads or orders from the same individual, entity, or IP address (CJ Section 1(d)(ii)), engaging in self-referral gaming, or purchasing items for commercial resale or post-credit return manipulation.
• Executing purchases using stolen credit cards, false identities, or invalid payment methods.
• Bypassing or attempting to bypass security features, webhook verification checks, rate limits, or access controls.
• Engaging in paid search advertising bidding on merchant trademarked keywords (TM+ bidding) or impersonating Dollarback or participating brand representatives.

5. Intellectual Property & Independent Publisher Relationship

All software, brand logos, visual designs, graphics, code, and content on Dollarback are the exclusive intellectual property of Dollarback or its licensors. Participating retailer names and trademarks remain the sole property of their respective brand owners. In accordance with CJ Affiliate Publisher Service Agreement Section 8(c), Dollarback operates strictly as an independent affiliate publisher; nothing on Dollarback creates or implies any partnership, joint venture, agency, franchise, sponsorship, or official endorsement between Dollarback and any participating retailer.

6. Disclaimer of Warranties

Dollarback Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or availability. Dollarback does not guarantee that shopping tracking will be uninterrupted or error-free.

7. Limitation of Liability

To the maximum extent permitted by law, Dollarback, its owners, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services or merchant transaction disputes.

8. Indemnification

You agree to defend, indemnify, and hold harmless Dollarback from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys' fees) resulting from your violation of these Terms or your misuse of the platform.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state in which Dollarback operates, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the federal or state courts of competent jurisdiction.

10. Modifications & Termination

Dollarback reserves the right to suspend or terminate any user account immediately and without prior notice for violation of these Terms. We reserve the right to amend these Terms at any time. Continued use of Dollarback following posted changes constitutes full acceptance of the updated Terms.
